Below are some of our most asked questions with answers. Q Why does Arizona have a Confidential Intermediary program?
A In the early 90's it was becoming clear that many adopted children and parents whom placed their children were anxious to know about each other even though they were happy in their lives. The problem was the state law had promised that all records related an adoption were to be sealed. The CI program was born from the need for contact balanced by the promise of unanimity unless both parties agree and sign affidavits.
Q What is a Confidential Intermediary? A It is exactly what the name implies. Confidential - all information found in our records search and all personal information learned regarding each party is kept in the strictest confidence forever. Intermediary - We are the go between in making initial contact, giving space and seeing if they wish contact or non identifying information exchange.
Q What can a Confidential Intermediary do that I can't? A A CI is state licensed and able to locate county juvenile adoption files, DES records, private adoption records, and view those for all file information. A CI can also get a copy of the original sealed birth certificate. You as an individual are limited to filing a court petition for non-identifying information of your adoption file. Q Who can start a search? A All members of the Triad and siblings. - The adoptive parents of an adoptee who is at least eighteen years of age, or, if the adoptive parents are deceased, the adoptee’s guardian.
- An adoptee if the adoptee is at least eighteen years of age.
- If an adoptee is deceased, the adoptee’s spouse if the spouse is the legal parent or guardian of any child of the adoptee.
- If an adoptee is deceased, any child of the adoptee who is at least eighteen years of age.
- Either of the birth parents of the adoptee.
- If the birth parents of an adoptee are deceased, the parent of the birth parent.
- A biological sibling of the adoptee if the sibling is at least eighteen years of age.
- Medical information search by court order
- Except as provided above, a Confidential Intermediary shall search for any persons under twenty-one years of age.
- 18 years or older and a former dependent child.
- 17 or under and a former dependent child. If under 18, your participation must include your adoptive parent, guardian or biological parent if he or she has legal custody and is not involved in a current juvenile court dependency case.
- Over 18 and you are the sibling of a former dependent child.
Q How long does the process take? A Each search is unique, but you can expect your search to take anywhere from 1 month to 6 months if your adoption was originated in Arizona.
Q What information can I get without signing the affidavit? A General Non identifying information including basic medical problems can be passed through the intermediary. No contact is allowed and no information will be given that could allow the other party to locate or contact the other until the affidavits are signed.
Q Can I choose to have no contact? A Yes. No one is pushed to make a decision that is not right for them at that time. Remember, all information is confidential and private unless all parties sign the affidavit.
Q What is SIX? A In 2007 the Arizona State Legislature extended the role of a Confidential Intermediary Program to include the Sibling Information Exchange (SIX) by enacting A.R.S. § 8-543, which provides former dependent children the ability to locate, and stay in touch with, siblings separated by a dependency action. Q Who can participate in SIX: A Siblings - 18 years or older and a former dependent child.
